What’s changed in property law? Having worked in conveyancing for many years, I’ve seen property law become far more complex, with increased compliance, municipal, sectional title and regulatory requirements. We’ve also seen how much more clients expect from their attorneys, not just processing a transfer, but guiding them through the entire journey. For me, the biggest change has reinforced something I value strongly: don’t just process the file; understand the client, anticipate the problem and think ahead.

A transfer or conveyancing matter that changed how you view property law? There have been many. Some of the most memorable matters started as what appeared to be straightforward transfers, only for us to uncover issues with building plans, deceased estates, title deeds or municipal accounts. Those experiences taught me that there is always more to a property transaction than what appears on paper. You have to understand the people and the story behind the property. That is something I’ve carried strongly into my role at Araujo Attorneys: know your client and know your file.

Legal mistakes people make when buying or selling property: Signing an agreement without really understanding it. People sometimes get caught up in the excitement of buying or selling and don’t consider the legal consequences. I also see problems caused by verbal promises, undisclosed issues, missing approvals and leaving important decisions until the last minute. My advice is always: ask the question. There is no such thing as a silly question when it involves your home, your investment or your money. Early advice can prevent a much bigger problem later.

A few things every South African should have in place before buying or selling property: Have a valid Will; understand exactly what you can afford, including the additional costs; properly understand the sale agreement before signing; make sure the property’s documentation and compliance requirements are in order; and choose professionals you trust. I’ve seen how much easier transactions are when people prepare properly from the beginning. A little preparation can save an enormous amount of stress later for the client and everyone else involved in the transaction.

Advice for property buyers and sellers in South Africa: Don’t rush, ask questions and get proper advice early. Property transactions can be exciting, but they can also be incredibly stressful because there is so much at stake. We want our clients to feel that they have someone in their corner – someone who understands the law but also understands the person behind the transaction. For me, great conveyancing isn’t just about getting a property registered; it’s about owning the process, communicating properly, solving problems and building relationships that last beyond registration.
